Terms of Use

1. Agreement and business identity

EVEQ is a software product provided by EVERPEAK INC, registered in the United States, with public correspondence at 300 Hwy 80 E, Greenwood, MS 38930, United States. By creating, accepting, purchasing, or using an EVEQ account, you agree to these Terms, the Privacy Notice, Acceptable Use Policy, Risk Disclosure, and any order terms presented before purchase.

If you use EVEQ for an organization, you represent that you have authority to bind that organization. In that case, “you” includes the organization.

2. Eligibility and account approval

You must be at least 18 years old, able to enter a binding agreement, and legally permitted to use EVEQ and any connected third-party service in your jurisdiction. Access may be invitation-based, restricted by region or intended use, or subject to account review. EVERPEAK INC may decline an access request where the service, payment method, jurisdiction, or intended activity is unsupported or presents legal, security, or abuse risk.

3. The EVEQ service

EVEQ provides software tools for market research, historical testing, monitoring, account controls, and user-directed operational workflows. Eligible features depend on the plan, configuration, jurisdiction, and supported third-party providers.

EVERPEAK INC does not accept trading deposits, hold customer funds or digital assets, operate an exchange, provide brokerage or money-transmission services, manage customer accounts, act as an investment adviser, or promise investment performance. Subscription fees pay for software access only.

4. Account security and administrators

You are responsible for accurate account information, all activity under your credentials, and the security of your email, password, devices, sessions, recovery methods, API credentials, and organization users. Notify Serve@npsayu.com promptly if unauthorized access is suspected.

An organization administrator may provision, restrict, review, or remove users and resources within the organization’s workspace. You are responsible for choosing authorized administrators and understanding the access they receive.

5. Subscription, payment, and delivery

This website does not currently publish a standard self-service subscription offer. Any paid access is governed by the price, billing interval, delivery timing, renewal, trial, cancellation, and refund terms presented in the applicable written offer or checkout before payment.

You authorize the applicable payment provider to charge the selected method only for fees and applicable taxes disclosed before payment. The payment provider may decline, delay, or require verification for a transaction.

The terms presented for a purchase and the Refund and Cancellation Policy govern cancellation and refund eligibility. The purchase-specific commercial terms control where they directly conflict with this section, subject to applicable law.

6. Third-party accounts and credentials

You may connect only a third-party account you are authorized to control. Brokers, exchanges, data vendors, AI providers, payment providers, and other integrations are independent services with their own terms, fees, permissions, privacy practices, eligibility requirements, and risks.

You authorize EVEQ to communicate with a connected provider only to deliver features you request. Use restricted credentials and disable withdrawal permission where supported. EVERPEAK INC does not control a third party’s acceptance, execution, pricing, custody, withdrawal, solvency, availability, or compliance decisions.

7. User-authorized instructions

Where enabled for an eligible account, EVEQ may transmit an instruction you approve individually or that an automated workflow generates under settings you authorize. An authorized automated workflow may transmit without separate confirmation for each instruction. You—not EVERPEAK INC—select the provider, account, permissions, strategy, parameters, controls, and whether to enable automated transmission.

Instructions can fail, be delayed, duplicated, partially filled, filled at an unexpected price, rejected, or produce an unintended result. You are responsible for monitoring the connected account and maintaining an independent method to restrict or revoke access.

8. Research, backtests, AI, and risk

Research, charts, alerts, strategy material, code, backtests, simulations, paper results, and AI-assisted output can be incomplete, inaccurate, stale, hypothetical, or unsuitable. They are not investment, financial, legal, tax, or regulatory advice and do not guarantee future performance.

Trading and automated activity can result in rapid and substantial loss, including loss of all capital in a third-party account. You assume the risks described in the Risk Disclosure and must independently review each decision and workflow.

9. Your content and feedback

You retain ownership of strategy content, configurations, and other material you submit, subject to third-party rights. You grant EVERPEAK INC a limited right to host, process, transmit, reproduce, and display that material only as reasonably necessary to provide, secure, support, and improve the requested service or comply with law.

You must have the rights and permissions needed for material you submit. If you voluntarily provide product feedback, EVERPEAK INC may use it without restriction or payment, without identifying you publicly unless you agree.

10. EVEQ software and intellectual property

Subject to these Terms and payment of applicable fees, EVERPEAK INC grants you a limited, non-exclusive, non-transferable, revocable right to access the hosted EVEQ service for your authorized internal use during the subscription. EVERPEAK INC and its licensors retain all rights in the software, branding, documentation, and service that are not expressly granted.

11. Acceptable use

You must comply with the Acceptable Use Policy. Prohibited conduct includes fraud, market manipulation, sanctions evasion, money laundering, unauthorized financial services, unauthorized account access, infringement, abuse of third-party systems, and attempts to bypass or disrupt service controls.

12. Availability and changes

The service may be changed, limited, suspended, or unavailable because of maintenance, security, legal requirements, market-provider changes, infrastructure failures, or other operational reasons. EVERPEAK INC does not promise uninterrupted or error-free operation. We may update features and integrations, but will not materially misrepresent the product purchased.

13. Suspension and termination

EVERPEAK INC may restrict or terminate access when reasonably necessary to protect users, systems, or third parties; investigate suspected misuse; respond to payment failure; comply with law or provider requirements; or enforce these Terms. Where appropriate, notice and an opportunity to address the issue may be provided.

You may stop using EVEQ at any time. Ending use does not itself cancel a recurring subscription; follow the cancellation process in the published billing policy.

14. Disclaimers

To the extent permitted by law, EVEQ is provided “as is” and “as available.” EVERPEAK INC disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. No statement, output, example, support response, or third-party content creates a guarantee of market, operational, or financial results.

Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.

15. Limitation of responsibility

To the extent permitted by law, EVERPEAK INC is not responsible for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits or opportunities; trading or market losses; loss of digital assets; or acts, outages, charges, or decisions of an independent third-party provider arising from use of EVEQ.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limits mandatory consumer rights.

16. Electronic communications

You agree that account, security, billing, legal, and service notices may be delivered electronically to the account contact information. Keep that information current. Marketing choices and delivery handling are described in the Email and Messaging Policy.

17. General terms

If part of these Terms is unenforceable, the remaining parts continue to apply. A failure to enforce a term is not a waiver. You may not transfer the agreement without written consent; EVERPEAK INC may transfer it as part of a lawful corporate transaction or service reorganization, subject to applicable notice requirements.

Any separate signed order form or business agreement controls where it directly conflicts with these online Terms. Governing law or dispute terms stated in that agreement apply; otherwise applicable law and mandatory conflict-of-law rules determine them.

18. Changes and contact

These Terms may be updated to reflect product, legal, security, or business changes. A new “Last updated” date will be posted, and material changes may be communicated through the service or account contact information where appropriate.
